By accessing our website and purchasing "Penetrating Trauma Special O.P.S." (hereinafter, "the Work" or "the Service"), you agree to and undertake to comply with the following Terms and Conditions.

1. Description of the Service and Educational Purpose

Penetrating Trauma Special O.P.S. is an interactive eBook and collection of clinical cases for educational purposes only, designed to stimulate clinical-surgical reasoning in healthcare professionals and students.

2. Medical Disclaimer

The Work is an educational training and simulation tool. The information and strategies presented do NOT constitute, under any circumstances, direct medical advice or substitute professional clinical judgment.

Decisions regarding the treatment of actual patients should be based on the individual assessment of each case by a qualified healthcare professional, considering the clinical context, available resources, and current medical literature. The authors and publishers assume no responsibility for the use of the information contained in this Work in actual clinical practice or for patient outcomes.

3. License of Use and Intellectual Property

  • Ownership: All content in the Work (text, images, videos, clinical cases, software, and methodology) is the exclusive intellectual property of Dr. Carlos Ordoñez and/or his licensors, protected by copyright laws.

  • License: Your purchase grants you a limited, personal, non-exclusive, and non-transferable license to access and use the Work for personal educational purposes.

  • Prohibitions: The following are strictly prohibited:

    • Share your login credentials (username and password).

    • Copy, reproduce, redistribute, transmit, record, sell, publicly broadcast, sublicense, or create derivative works from the content.

    • Reverse engineer or attempt to extract the source code from the platform.

4. Accounts, Subscriptions, and Payments

  • Access: Purchase of the Work grants access. Specific terms (e.g., lifetime access, annual subscription, 6 months, or per case) will be clearly indicated on the payment page at the time of purchase.

  • Account: You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

  • Payment Processor: All payments are made through external, secure payment gateways. We do not store sensitive financial information.

5. Refund Policy

Our refund policy is strict due to the digital and irrevocable nature of the product.

The conditions, eligibility, and process for requesting a refund are governed by our official"Refund Policy," which is publicly available on our site (e.g., /policies/refund-policy). As detailed in that policy, the right of withdrawal is lost once the digital content has been activated or accessed.

6. Suspension and Termination

We reserve the right to suspend or terminate your access to the Work, without prior notice and without entitlement to a refund, if we determine that you have seriously breached these Terms, in particular (but not limited to) the prohibitions in Clause 3 (Intellectual Property) or Clause 7 (User Conduct).

7. User Conduct

You agree not to use the Service for illegal purposes or to infringe the rights of third parties. You must not attempt to breach the security of the site, interfere with its operation, or access unauthorized data.

8. Limitation of Liability

You agree to use this site and the Work at your own risk. To the maximum extent permitted by law, Penetrating Trauma SPECIAL O.P.S. and its authors shall not be liable for any direct, indirect, incidental, or consequential damages arising out of the use or inability to use our service.

Our total cumulative liability, in any case, shall be limited to the amount actually paid by you for the Service in the 12 months prior to the event giving rise to the claim.

10. Applicable Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of the Republic of Colombia. Any dispute, controversy, or claim arising out of these Terms shall be submitted to the exclusive jurisdiction of the competent courts and tribunals of the city of Cali, Valle del Cauca.
